Our terms

1.            These terms

1.1          These are the terms and conditions on which we supply products to you, whether these are goods, services or digital content.

1.2          Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss.

2.            Information about us and how to contact us

2.1          We are BLACK COUNTRY BARBELL a company registered in England and Wales. Our company registration number is 10273260 and our registered office is at BLACK COUNTRY BARBELL, TALBOT STREET, STOURBRIDGE, DY8 1SN.

2.2          You can contact us by writing to us at contact@blackcountrybarbll.co.uk and  Black Country Barbell, Talbot Street, Stourbridge, DY8 1SN.

2.3          If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us in your order.

2.4          When we use the words "writing" or "written" in these terms, this includes emails.

3.            Our contract with you

3.1          Our acceptance of your order will take place when we email you to accept it, at which point a contract will come into existence between you and us.

3.2          If we are unable to accept your order, we will inform you of this and will not charge you for the product. This might be because the product is out of stock, because of unexpected limits on our resources which we could not reasonably plan for, because we have identified an error in the price or description of the product or because we are unable to meet a delivery deadline you have specified.

3.3          We will assign an order number to your order and tell you what it is when we accept your order. It will help us if you can tell us the order number whenever you contact us about your order.

4.            Our products

4.1          The images of the products on our website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that a device's display of the colours accurately reflects the colour of the products. Your product may vary slightly from those images. However, orders will only be processed if there are no material errors in the description of the goods or their prices as advertised on this website. Any weights, dimensions and capacities given about the goods are approximate only.

4.2          If we are making the product to measurements you have given us you are responsible for ensuring that these measurements are correct. You can find information and tips on how to measure on our website or by contacting us.

5.            Your rights to make changes

5.1          If you wish to make a change to the product you have ordered please contact us. We will let you know if the change is possible. If it is possible we will let you know about any changes to the price of the product, the timing of supply or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change. If we cannot make the change or the consequences of making the change are unacceptable to you, you may want to end the contract (see clause 8- Your rights to end the contract).

6.            Our rights to make changes

6.1          We may change the product to reflect changes in relevant laws and regulatory requirements and to implement minor technical adjustments and improvements.  These changes will not affect your use of the product.

6.2          In addition, we may make changes to these terms or the product, but if we do so we will notify you and you may then contact us to end the contract before the changes take effect and receive a refund for any products paid for but not received.

7.            Providing the products

7.1          The costs of delivery will be as displayed to you before checkout of the product on our online store.

7.2          All orders are subject to acceptance and availability.

7.3          You are able to correct errors on your order up to the point on which you click on “submit” during the ordering process.

7.4          During the order process we will let you know when we will provide the products to you.

(a)       If the products are goods we will deliver them to you as soon as reasonably possible.  We will contact you with an estimated delivery date.

7.5          If our supply of the products is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products you have paid for but not received.

7.6          If you have asked to collect the products from our premises, you can collect them from us at any time during our working hours of 6.30am – 10.00pm on weekdays (excluding public holidays) and 8am – 8pm on Saturdays and 8am – 6pm on Sundays.

7.7          If no one is available at your address to take delivery and the products cannot be posted through your letterbox, we will leave you a note informing you of how to rearrange delivery or collect the products from a local depot.

7.8          If you do not collect the products from us  as arranged or if, after a failed delivery to you, you do not re-arrange delivery or collect them from a delivery depot we will contact you for further instructions and may charge you for storage costs and any further delivery costs. If, despite our reasonable efforts, we are unable to contact you or re-arrange delivery or collection we may end the contract and clause 10.2 will apply.

7.9          If you do not allow us access to your property to perform the services as arranged (and you do not have a good reason for this) we may charge you additional costs incurred by us as a result. If, despite our reasonable efforts, we are unable to contact you or re-arrange access to your property we may end the contract and clause 10.2 will apply.

7.10        You have legal rights if we deliver any goods late. If we miss the delivery deadline for any goods then you may treat the contract as at an end straight away if any of the following apply:

(a)       we have refused to deliver the goods;
(b)       delivery within the delivery deadline was essential (taking into account all the relevant circumstances); or
(c)        you told us  before we accepted your order that delivery within the delivery deadline was essential.

7.11        A product which is goods will be your responsibility from the time we deliver the product to the address you gave us or you collect it from us.

7.12        You own a product which is goods once we have received payment in full.

7.13        We may need certain information from you so that we can supply the products to you. If so, we will contact you to ask for this information. If you do not give us this information within a reasonable time of us asking for it, or if you give us incomplete or incorrect information, we may either end the contract (and clause 10.2 will apply) or make an additional charge of a reasonable sum to compensate us for any extra work that is required as a result. We will not be responsible for supplying the products late or not supplying any part of them if this is caused by you not giving us the information we need within a reasonable time of us asking for it.

7.14        We may have to suspend the supply of a product to:

(a)       deal with technical problems or make minor technical changes;
(b)       update the product to reflect changes in relevant laws and regulatory requirements;
(c)        make changes to the product as requested by you or notified by us to you (see clause 6).

7.15        If you do not pay us for the products when you are supposed to (see clause 12.4) and you still do not make payment within 7 days of us reminding you that payment is due, we may suspend supply of the products until you have paid us the outstanding amounts.

8.            Your rights to end the contract

8.1          Under The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 SI 2013/3134 you have the legal right to cancel your order up to 14 calendar  days after the day on which you receive your goods (with the exception of any made to order items). You do not need to give us any reason for cancelling your contract nor will you have to pay any penalty.

8.2          Should you wish to cancel your order you must notify us by email or post.

8.3          You cannot cancel your contract if the goods you have ordered are bespoke (i.e. made to order), newspapers or magazines or if you have taken any audio or video recording or computer software out of the sealed package in which it was delivered to you.

8.4          If you have received the goods before you cancel your contract then you must send the goods back to our contact address at your own cost and risk. If you cancel your contract but we have already processed the goods for delivery, you should not unpack the goods when they are received by you and you must send the goods back to us at our contact address at your own cost and risk as soon as possible.

8.5          Once you have notified us that you are cancelling your contract, and we have either received the goods back or, if earlier, received evidence that you have sent the goods back, we will refund any sum debited by us from your credit or debit card within 14 calendar days.

8.6          We may make a deduction from your refund for any loss in the value of the goods supplied if the loss is the result of unnecessary handling by you (for example using or wearing the goods prior to cancellation)

9.            How to end the contract with us (including if you have changed your mind)

9.1          To end the contract with us, please let us know by doing one of the following: 

(a)       Email. Email us at contact@blackcountrybarbell.couk. Please provide your name, home address, details of the order and, where available, your phone number and email address.
(b)       Online. Complete the enquiries form on our website.
(c)        By post. Write to us at: Black Country Barbell, Talbot Street, Stourbridge, west Midland, DY8 1SN. Ensure you include details of what you bought, when you ordered or received it and your name and address.

10.         Our rights to end the contract

10.1        We may end the contract for a product at any time by writing to you if:

(a)       you do not make any payment to us when it is due and you still do not make payment within 7 days of us reminding you that payment is due;
(b)       you do not, within a reasonable time of us asking for it, provide us with information that is necessary for us to provide the products;
(c)        you do not, within a reasonable time, allow us to deliver the products to you or collect them from us; or
(d)       you do not, within a reasonable time, allow us access to your premises to supply the services.

10.2        We reserve the right not to process your order if:

(a)       We have insufficient stock to deliver the goods you gave ordered;
(b)       We do not deliver to your area; or
(c)        One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
(d)       If we do not process your order for the above reasons, we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit/debit card as soon as possible, but in any event within 14 days.

10.3        If we end the contract in the situations set out in clause 10.1 we will refund any money you have paid in advance for products we have not provided but we may deduct or charge you reasonable compensation for the net costs we will incur as a result of your breaking the contract.

11.         If there is a problem with the product

11.1        If you have any questions or complaints about the product, please contact us. You can write to us at contact@blackcountrybarbell.co.uk or Black Country Barbell, Tlbot Street, Stourbridge, West Midland, DY8 1N. Alternatively, please speak to one of our staff in-gym.

11.2        We are under a legal duty to supply goods that are in conformity with this contract and in accordance with the Consumer Rights Act 2015 (the Act).

11.3        If you wish to exercise your legal rights to reject goods which do not conform with the Act you must either return them in person to where you bought them or post them back to us.

12.         Price and payment

12.1        The prices payable for goods that you order are as set out on our website. All prices are inclusive of VAT at the current rates and are correct at the time of entering information.

12.2        If the rate of VAT changes between your order date and the date we supply the product, we will adjust the rate of VAT that you pay, unless you have already paid for the product in full before the change in the rate of VAT takes effect.

12.3        We will take payment upon receipt of your order from your credit or debit card. We accept no liability if a delivery is delayed because you did not give us the correct payment details. If it is not possible to obtain full payment for the goods from you, then we can refuse to process your order and/or suspend any further deliveries to you. This does not affect any other rights we may have.

12.4        If you think an invoice is wrong please contact us promptly to let us know.

13.         Liability

13.1        Unless agreed otherwise, if you do not receive goods ordered by you within 30 days of the date on which you ordered them and decide to cancel the order rather than re-arrange delivery we will provide you with a full refund.

13.2        We are only responsible for losses that are a natural, foreseeable consequence of our breach of these terms and conditions.  We do not accept liability if we are prevented or delayed from complying with our obligations set out in these terms and conditions by anything you (or anyone acting with your express or implied authority) does or fails to do, or is due to events which are beyond our reasonable control.

13.3        Furthermore, we do not accept liability for any losses related to any business of yours including but not limited to: lost data, lost profits, lost revenues or business interruption.

13.4        You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site.  The importation or exportation of certain of our goods to you may be prohibited by certain national laws.  We make no representation and accept no liability in respect of the export or import of the goods you purchase.

13.5        Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.   You have certain rights as a consumer including legal rights (e.g. under the Act) relating to faulty and/or misdescribed goods.

14.         Law, jurisdiction and language

14.1        This website, any content contained therein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English law. Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.

15.         How we may use your personal information

15.1        We will use the personal information you provide to us:

(a)       to supply the products to you;
(b)       to process your payment for the products; and
(c)        if you agreed to this during the order process, to give you information about similar products that we provide, but you may stop receiving this at any time by contacting us.

15.2        We will only give your personal information to third parties where the law either requires or allows us to do so.

15.3        You acknowledge and agree to be bound by the terms of our privacy policy.

16.         Other important terms

16.1        We may transfer our rights and obligations under these terms to another organisation.

16.2        You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing.

16.3        This contract is between you and us. No other person shall have any rights to enforce any of its terms.

16.4        Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

16.5        If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.

16.6        Alternative dispute resolution is a process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court. If you are not happy with how we have handled any complaint, you may submit the dispute for online resolution to the European Commission Online Dispute Resolution platform.
